Welcome to CappingAlpha. These Terms of Service (the "Terms") govern your access to and use of the website at cappingalpha.com, any associated subdomains, applications, and any related services (collectively, the "Site" or the "Service"). The Site is operated by CappingAlpha LLC, a Florida limited liability company ("CappingAlpha," "we," "us," or "our").
By creating an account, completing a purchase, or otherwise accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you may not use the Site.
Please read carefully. Sections 13 (Limitation of Liability), 15 (Dispute Resolution; Mandatory Arbitration; Class Action Waiver), and 16 (Governing Law and Venue) materially affect your legal rights.
By accessing the Site, creating an account, or completing any purchase, you (a) acknowledge that you have read and understood these Terms; (b) agree to be bound by these Terms; and (c) represent that you have the legal capacity to enter into a binding agreement. If you are accessing the Site on behalf of another person or entity, you represent that you have authority to bind that person or entity to these Terms.
We may revise these Terms from time to time at our discretion. We will indicate the date of the most recent revision at the top of this page. Material changes may be communicated by email, by a notice posted on the Site, or both. Continued use of the Site after revised Terms are posted constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, your sole remedy is to discontinue use of the Site and cancel any active subscription.
You must be at least 18 years of age to access or use the Site. By using the Site, you represent and warrant that:
The minimum age to place a wager at a third-party sportsbook is set by that sportsbook and by applicable state law, and may be 21 years of age or higher. CappingAlpha does not facilitate wagering and does not verify your eligibility to wager at any third-party site.
Nothing on the Site constitutes, or is intended to constitute, betting advice, gambling advice, financial advice, investment advice, tax advice, accounting advice, or legal advice. No content on the Site is a recommendation that you place, refrain from placing, increase, or decrease any wager.
Pick rankings, scores, MVP designations, capper performance histories, line comparisons, public-betting figures, prediction-market data, and any commentary made available on the Site are provided for informational and entertainment purposes only. They reflect a proprietary scoring methodology applied to publicly available signals and third-party data feeds. They do not reflect, and are not predictive of, the outcome of any sporting event or wager.
You are solely responsible for your decisions, including any wagers placed on third-party sportsbooks or platforms. CappingAlpha is not your fiduciary, agent, or advisor.
CappingAlpha is strictly an informational and research service. We do not accept wagers. We do not hold or transmit funds for the purpose of wagering. We do not facilitate or participate in any betting transaction. We are not a sportsbook, a daily fantasy operator, a licensed gaming operator, or a registered investment adviser.
Voting features on the Site (where users may cast a non-monetary "for or against" vote on a pick slot) are tracking tools for community sentiment only. They do not involve real money, real prizes, real consideration, or any element of wagering, and do not create any obligation by CappingAlpha to any user.
The Site displays performance figures, including but not limited to MVP win/loss records, hypothetical profit and loss ("P/L") figures, daily and cumulative graphs, and capper performance histories (collectively, "Performance Figures"). All Performance Figures are hypothetical. They are produced by applying our proprietary scoring model to historical data and the betting line recorded at the time each pick qualified for tracking, do not represent the results of any actual wager, and are presented with the benefit of hindsight.
Performance Figures have inherent limitations. Among them: (a) they assume a flat unit (typically a flat $10 unit unless otherwise indicated) regardless of bankroll or position sizing; (b) they assume the user could have placed each wager at the line recorded when the pick qualified for tracking, which may not have been available at any given moment; (c) they do not account for taxes, fees, juice, vig adjustments, line shopping, market availability, bet limits, account restrictions, or transaction costs; (d) they do not account for human factors that affect actual betting outcomes; and (e) results are derived in part from data provided by third parties that may contain errors, omissions, or delays.
No representation is made that any user following the picks, scores, or rankings shown on the Site would have achieved or would achieve results similar to those shown. Past hypothetical performance is not indicative of future results.
Scoring window. Pick scores are dynamic and evolve throughout the day as new signals are received and processed by the scoring engine. A pick's score is locked five (5) minutes after the actual start of the corresponding game, as reported by our live data sources. Because games can begin later than scheduled (delays, weather, broadcast adjustments, schedule changes), the lock window is keyed to the actual start, not the scheduled start. Scores, rankings, MVP status, and related statistics may shift during the active scoring window. CappingAlpha does not warrant that any score shown at a given moment will be the final score for that pick.
Methodology is proprietary. The exact weights, signal sources, agent configurations, and adjustments that comprise the scoring model are proprietary trade secrets. We do not publish the formula, and we reserve the right to revise the model at any time, with or without notice.
The Site aggregates and displays data from third-party sources, which may include, without limitation, ESPN, The Odds API, ActionNetwork, Polymarket, Kalshi, OpenWeatherMap, Anthropic, Stripe, and Discord (collectively, "Third-Party Sources"). CappingAlpha does not own, control, or guarantee the accuracy, timeliness, completeness, or availability of data provided by Third-Party Sources. Third-Party Sources are not affiliated with, sponsored by, or endorsed by CappingAlpha, and CappingAlpha is not affiliated with, sponsored by, or endorsed by any Third-Party Source.
To the extent that Third-Party Sources impose terms of service on downstream display of their data, those terms are incorporated by reference into your use of the Site, and you agree to comply with them. CappingAlpha is not responsible for any errors, omissions, delays, or interruptions originating from Third-Party Sources.
Picks scored on the Site originate from independent third-party handicappers. Those individuals are not employed by, affiliated with, sponsored by, or endorsed by CappingAlpha, and their inclusion on the Site is not an endorsement of them or of any pick. We do not warrant the accuracy of any pick and present picks only to score and rank them under our methodology.
The Site and all of its contents, including, without limitation, the scoring model, source code, software, design, graphics, logos, names, marks, layout, picks, rankings, scores, breakdowns, capper histories, MVP records, performance graphs, derived data, written commentary, and any related documentation (collectively, the "CappingAlpha Materials"), are the property of CappingAlpha LLC or its licensors and are protected by United States and foreign copyright, trademark, trade-secret, and other intellectual-property laws.
Subject to your compliance with these Terms, CappingAlpha grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and view the Site and the CappingAlpha Materials made available to your subscription tier, solely for personal, non-commercial use. No other rights are granted.
Anti-scraping; anti-reverse engineering. You may not, and may not permit any third party to: (a) copy, reproduce, distribute, publicly display, modify, create derivative works of, sell, license, sublicense, rent, or lease any portion of the CappingAlpha Materials; (b) use any robot, spider, scraper, crawler, headless browser, automated tool, or other automated means to access, search, monitor, harvest, or copy any portion of the Site or any data appearing on it; (c) attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code, weights, signal sources, or methodology of the scoring model; (d) bypass, disable, or interfere with any rate limit, paywall, authentication, or security measure; (e) use the Site or any output of the Site to train, improve, evaluate, or benchmark any machine-learning model, ranking system, betting product, or competing service; or (f) remove, alter, or obscure any copyright, trademark, or other notice on the Site.
Violation of this Section is a material breach of these Terms and grounds for immediate termination, suspension, and injunctive relief, without limiting any other remedy available to us.
To access certain features of the Site you must create an account. You agree that:
Single-user accounts. Subscriptions and access codes are for personal, individual use only. Sharing account credentials, sharing access codes, or making the Site available to any other person under your account is prohibited and is grounds for immediate termination. Promotional or comp access codes may be revoked at our discretion.
CappingAlpha offers paid access on the following terms, each of which may change from time to time:
Billing is processed by Stripe and is subject to Stripe's terms. By providing payment information, you authorize CappingAlpha and Stripe to charge the payment method on file for all subscription fees, taxes, and any other amounts due, including renewal fees.
Auto-renewal disclosure. Your weekly or annual subscription will automatically renew at the end of each billing period at the then-current rate until you cancel. By subscribing, you provide electronic authorization for future renewal charges. You may cancel at any time through your Stripe billing portal or by contacting us at [email protected]. Cancellation takes effect at the end of the then-current billing period, and you will retain access until that period ends. We do not provide refunds for the remainder of any billing period after cancellation. For annual subscriptions, we will send a reminder by email before each renewal. If you cannot reach the billing portal, you may cancel by emailing [email protected] and we will process it.
No refunds. Except where required by applicable law, all fees are non-refundable, including amounts paid for day passes, partial billing periods, unused subscription time after cancellation, and any prior period in which you did not actively use the Site. If you believe a charge was made in error, please contact [email protected] within thirty (30) days of the charge and we will review your case in good faith.
Price changes. We may change subscription prices at any time. If we do, the new price will apply at the next renewal following advance notice to you (by email or in-app). Continued use after the new price takes effect constitutes acceptance of the new price. You may cancel before the next renewal if you do not accept the new price.
Taxes. Fees do not include any sales, use, value-added, or similar taxes. You are responsible for paying all applicable taxes other than taxes based on our net income.
If you have a billing dispute, you agree to contact us first at [email protected] and to attempt resolution in good faith before initiating a chargeback or payment dispute with your bank, card issuer, or any other party.
Initiating a chargeback for a charge you authorized, or for a non-refundable charge as defined in these Terms, constitutes a material breach of these Terms. Without limiting any other remedy, we reserve the right, in our sole discretion, to (a) immediately suspend or terminate your account and access; (b) bar you from creating future accounts; (c) recover the disputed amount, any chargeback fees imposed by Stripe or your card issuer, and reasonable collection costs; and (d) refer the matter to a collections agency.
We may suspend or terminate your account and access to the Site, in whole or in part, at any time and without prior notice if we have reason to believe that: (a) you have breached these Terms; (b) you have engaged in fraud, attempted fraud, or chargeback abuse; (c) your continued use poses a security or operational risk to CappingAlpha or other users; (d) we are required to do so by applicable law, court order, or law enforcement request; or (e) your subscription has lapsed for non-payment.
You may terminate your account at any time by canceling any active subscription and discontinuing use of the Site. Upon termination, all licenses granted to you under these Terms automatically end. Sections that by their nature should survive termination (including Sections 4, 6, 8, 11, 13, 14, 15, 16, 19, 25, and 26) will survive.
The site and all content are provided on an "as is" and "as available" basis, with all faults and without warranty of any kind. To the maximum extent permitted by applicable law, CappingAlpha and its affiliates, licensors, and service providers disclaim all warranties, express, implied, or statutory, including without limitation any warranty of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, currency, completeness, or quiet enjoyment, and any warranty arising from course of dealing, course of performance, or usage of trade.
Without limiting the foregoing, CappingAlpha makes no warranty that the site will be uninterrupted, error-free, secure, free of viruses or other harmful code, or that any data, content, scores, rankings, or performance figures will be accurate, timely, complete, or reliable. CappingAlpha does not warrant the outcome of any sporting event or any wager that any user may place at any third-party platform.
Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the above exclusions apply to the maximum extent permitted by law.
To the maximum extent permitted by applicable law, in no event will CappingAlpha, its affiliates, licensors, service providers, officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including without limitation damages for lost profits, lost revenue, lost data, lost business opportunity, gambling losses, loss of goodwill, or substitute services, arising out of or relating to these Terms or your use of, or inability to use, the site, even if CappingAlpha has been advised of the possibility of such damages and even if a limited remedy fails of its essential purpose.
In no event will the aggregate liability of CappingAlpha to you for any and all claims arising out of or relating to these Terms or your use of the site exceed the lesser of (a) one thousand United States dollars ($1,000.00) or (b) the total amount actually paid by you to CappingAlpha in the six (6) months immediately preceding the event giving rise to the claim.
The limitations in this Section are a material basis of the bargain between you and CappingAlpha. They apply regardless of the form of action, whether in contract, tort (including negligence), strict liability, or otherwise.
Some jurisdictions do not allow the limitation or exclusion of certain damages. In those jurisdictions, the above limitations apply to the maximum extent permitted by law.
You agree to defend, indemnify, and hold harmless CappingAlpha, its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, and agents, from and against any and all claims, demands, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your access to or use of the Site; (b) your breach of these Terms; (c) your violation of any law or the rights of any third party; (d) any wager you place at any third-party sportsbook, prediction market, daily fantasy operator, or other platform, including any loss arising from such wager; and (e) any chargeback or payment dispute initiated by you in breach of Section 11.
We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, at your expense, in which event you will cooperate with us in asserting any available defenses. You will not settle any matter that subjects CappingAlpha to any liability or admission without our prior written consent.
Informal resolution. Before filing any claim, you agree to first attempt informal resolution by emailing [email protected] with a description of the claim and the relief requested, and by allowing CappingAlpha thirty (30) days to respond. The parties will negotiate in good faith for at least thirty (30) days from delivery of the notice.
Binding arbitration. Except as set forth below, any dispute, claim, or controversy arising out of or relating to these Terms or the Site, that the parties cannot resolve informally, will be resolved by final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as modified by these Terms. The arbitration will be conducted in the Florida county in which CappingAlpha LLC is registered, or remotely by videoconference, at the election of the consumer claimant. The arbitrator may award only the relief that a court could award under applicable law. Judgment on the award may be entered in any court of competent jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this Section.
Class action waiver. You and CappingAlpha agree that any dispute will be brought in your or our individual capacity only, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate or join claims of more than one person and may not preside over any form of representative or class proceeding. If a court or arbitrator determines that this class action waiver is unenforceable as to any claim or remedy, that claim or remedy (and only that claim or remedy) will be severed and pursued in a court of competent jurisdiction.
Carve-outs. Either party may bring (a) an individual claim in small-claims court for any dispute within that court's jurisdiction, in lieu of arbitration; or (b) an action seeking injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual-property rights or trade secrets, including without limitation Section 8 (Anti-Scraping).
Opt-out. You may opt out of this arbitration agreement by sending written notice to [email protected] within thirty (30) days of the date you first accepted these Terms. The notice must include your name, the email address associated with your account, and a clear statement that you are opting out of the arbitration agreement. If you opt out, Section 17 (Governing Law and Venue) continues to apply.
These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Florida, United States of America, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Subject to Section 16, the exclusive jurisdiction and venue for any action permitted to be brought in a court (rather than in arbitration) lies in the state and federal courts located in the Florida county in which CappingAlpha LLC is registered, and the parties consent to personal jurisdiction in those courts and waive any objection to venue or to inconvenient forum.
The Site is a work in progress. We may, at any time and without notice, add, change, suspend, withdraw, or discontinue features, content, data sources, sports coverage, pricing, scoring methodology, or any other aspect of the Service. We are not liable to you or to any third party for any modification, suspension, or discontinuance of the Site.
From time to time, we may make beta, preview, alpha, experimental, or early-access features available. Those features are identified as such, are provided on an as-is basis, may be modified or removed without notice, carry no service-level commitment, and are excluded from the warranty disclaimers and liability caps only to the extent expressly stated.
Neither party will be liable to the other for any failure or delay in performance to the extent that the failure or delay results from causes beyond that party's reasonable control. Such causes include, without limitation: acts of God; war; terrorism; pandemic, epidemic, or other public-health emergency; governmental action, order, or regulation; civil unrest or labor disputes; fire, flood, earthquake, severe weather, or other natural disaster; internet, hosting, or network outages; failures, errors, delays, or interruptions of any Third-Party Source (including, without limitation, ESPN, The Odds API, ActionNetwork, Polymarket, Kalshi, Anthropic, Stripe, Discord, or Railway); cyberattacks; and the action or inaction of any third party. The affected party will use reasonable efforts to resume performance as soon as practicable.
The Site is operated from, and directed primarily to, users in the United States. We make no representation that the Site or any content is appropriate or available for use in any other jurisdiction. If you choose to access the Site from outside the United States, you do so on your own initiative and are solely responsible for compliance with local laws.
You represent and warrant that you are not located in, under the control of, or a national or resident of any country to which the United States has embargoed goods or services, and that you are not listed on any United States government list of prohibited or restricted parties.
Sports wagering is restricted or unlawful in some United States states and many foreign jurisdictions. It is your sole responsibility to understand the laws that apply to you and to observe them. CappingAlpha does not provide legal advice on the legality of online sports wagering or on the legality of accessing third-party sportsbooks.
The Site may contain links to third-party sportsbooks, prediction markets, data providers, or other platforms. Some links may now or in the future be affiliate links, which means that CappingAlpha may receive compensation if you take an action after clicking such a link. Compensation received from any affiliate program does not influence the scoring model, capper rankings, MVP designations, or other content on the Site.
Linked third-party sites are not under our control. We do not endorse, monitor, or assume responsibility for any third-party content, policies, or practices, and we are not liable for any loss or damage arising from your access to or use of any third-party site.
Gambling can be addictive and carries risk of financial harm. CappingAlpha encourages responsible gambling. If you or someone you know may have a gambling problem, please seek help:
Many states operate voluntary self-exclusion programs that allow you to ban yourself from wagering at licensed operators. Check with your state's gaming regulator for details.
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the collection and use of information as described in the Privacy Policy.
CappingAlpha respects the intellectual-property rights of others and expects users to do the same. If you believe that any content on the Site infringes a copyright that you own or control, please send a written notice that satisfies the requirements of 17 U.S.C. § 512(c)(3) to:

We may, at our discretion and in appropriate circumstances, terminate the accounts of users who are repeat infringers.
If you submit feedback, suggestions, ideas, votes, ratings, or other materials to CappingAlpha through the Site, by email, or otherwise (collectively, "Submissions"), you grant CappingAlpha a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, prepare derivative works of, display, and exploit the Submissions for any purpose, in any medium, without attribution or compensation to you. You represent that your Submissions are your own, do not infringe the rights of any third party, and do not include any confidential information that you do not wish to disclose.
Assignment. You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempted assignment without consent is void. We may assign these Terms, in whole or in part, to any successor in connection with a merger, acquisition, reorganization, financing, or sale of all or substantially all of our assets or business, without your consent and without notice.
Notices. Notices to CappingAlpha must be sent to [email protected]. Notices to you may be sent to the email address associated with your account or posted to the Site, and are deemed received upon sending or posting.
Electronic communications. You agree that we may provide agreements, notices, billing records, disclosures, and other communications to you electronically, by email or by posting them on the Site, and that this satisfies any legal requirement that those communications be in writing. This consent supports the billing authorization in Section 10 and the notice of changes in Section 2.
Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will continue in full force and effect.
No waiver. No failure or delay by CappingAlpha in exercising any right under these Terms operates as a waiver of that right. Any waiver must be in writing and signed by CappingAlpha to be effective.
Entire agreement. These Terms, together with the Privacy Policy and any subscription, billing, or order terms presented at checkout, constitute the entire agreement between you and CappingAlpha regarding the Site and supersede any prior or contemporaneous agreements, communications, or proposals, whether oral or written.
Survival. Sections 4, 6, 8, 10 (with respect to amounts due), 11, 13, 14, 15, 16, 17, 19, 20, 25, and 26 will survive any termination of these Terms.
Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.
Independent contractors. Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and CappingAlpha.
Construction. The words "include," "includes," and "including" are deemed to be followed by the words "without limitation." Use of singular includes the plural and vice versa.
